The Chaparral Pines Community Association is governed by our CC&Rs, By Laws, and our policies and procedures. Below are links to these governing documents.

CC&R’s

When anyone buys a home in our community you are a part of a homeowners' association (HOA). The rules of the HOA community are described in what's called the Declaration of Covenants, Conditions, and Restrictions (CC&Rs). They describe the requirements and limitations of what owners can do with their property. The goal of the CC&Rs is to protect, preserve, and enhance property values in the community.

Your community’s bylaws establish the structure of day-to-day governance of your homeowners association.

Articles of Incorporation

Homeowner’s associations are a non-profit organization and must file paperwork with the Secretary of State’s Office before a developer sells any property within the HOA. The Articles of Incorporation are typically brief and contain basic information such as an Association’s name, location, and purpose.

CHAPARRAL PINES COMMUNITY ASSOCIATION, INC.

 DIRECTORS’ RESOLUTION REGARDING

POLITICAL CANVASSING AND SOLICITATIONS

WITHIN THE COMMUNITY

 

The Board of Directors for Chaparral Pines Community Association Inc. (“Association”), by majority vote of directors meeting on the date stated herein below, do hereby adopt the following resolution:

WHEREAS, Article II, Section 2.1(c) of the Declaration of Covenants, Conditions, and Restrictions for Chaparral Pines, recorded on February 27, 1996 in the Office of the Gila County Recorder at Fee No. 96-002772 (and as amended thereafter) (the “CC&R’s”) provides that every Owner’s right and easement of use, access and enjoyment in and to the Common Area is subject to “[t]he right of the Board to adopt rules, regulations or policies regulating the use and enjoyment of the Common Area, including rules restricting use of recreational facilities within the Common Area to occupants of Dwelling Units and their guests, and rules limiting the number of occupants and guests who may use the Common Area.”

Article III, Section 3.1 of CC&R’s provides: “The Association shall be the primary entity for enforcement of this Declaration and such reasonable rules regulating use of the Properties as the Board may adopt.” 

Article IV, Section 4.2(a) of the CC&R’s specifically authorizes the Board of Directors to promulgate use restrictions and rules providing that the Board “may adopt rules which modify, cancel, limit, create exceptions to, or expand the Initial Use Restrictions set forth in Exhibit ‘C.’”        

WHEREAS, Article V, Section 5.7 provides: “The Association may, but shall not be obligated to, maintain or support certain activities within the Properties designed to make the Properties safer than they otherwise might be.” 

NOW THEREFORE, the Board of Directors hereby adopts the following rules:

1.         The following activities are prohibited within the Chaparral Pines Community Association:

  A.        door-to-door political activities, including but not limited to political campaigning, canvassing, fundraising, membership drives, solicitations of support or opposition regarding any political candidates for public office;

  B.        door-to-door circulation of political petitions, voter registration, solicitations of support or opposition regarding any candidate nomination petition, petitions in support of or opposition to an initiative, referendum or recall, or other political issues.

  C.        the use of any Common Area, Area of Common Responsibility, Association Private Amenities, easements, recreational facilities, corridors, roadways, walkways or any other real property which the Association now or hereafter owns or otherwise holds possessory or use rights in, for the political activities described above.

2.         These rules and restrictions Resolution and rules apply to all Owners and Members, as well as their tenants, assigns, guests, invitees and their respective agents and employees.

3.         The Association is a private neighborhood community that restricts vehicular and pedestrian access to private property.  Its roadways, sidewalks, walkways, facilities and amenities are not dedicated for public use or generally open to the public.  This resolution is to provide notice to Owners, Members, community residents, tenants and their respective guests and invitees, that the Association’s private property, roadways, sidewalks, amenities and facilities are not to be made available for such political activities and the Association reserves the right to prevent entry into the community and exercise any available rights and remedies, civil or criminal, to enforce these rules and its private property rights. 

This Resolution shall be effective as of the date adopted herein below, with notice to the membership in accordance with Article IV, Section 4.2(c) of the CC&R’s.

We, the undersigned, do hereby certify that we are duly elected and acting directors and officers of the Chaparral Pines Community Association, Inc., and that the foregoing Resolution was duly adopted by a majority vote of the Board of Directors at a meeting thereof held on the 27th day of September, 2019.

Political Sign Resolution

Subject:          Political Sign/Political Flag/Flag Resolution

 

With all the recent concerns regarding flags in the community (some of them being referred to as political signs) and also political signs being posted in the community, management thought it would be best to have an adopted policy to be followed.  The following policy is based off of CC&R’s for Chaparral Pines, the federal and state protections for certain flags, and Town of Payson rules for political signs/political flags.
